These Terms of Service govern use of InfamouslyE.com and purchases made from Infamously E. By accessing the website, creating an account, or purchasing merchandise, you agree to these Terms to the extent permitted by applicable law.

Store

Throughout these Terms, "Infamously E," "we," "our," and "us" refer to the merchant operating the Infamously E online store. Our ecommerce platform is provided by Shopify. We may use third-party service providers for functions including payment processing, fraud prevention, production, printing, order fulfillment, shipping, analytics, marketing, and customer service. Those providers assist us in delivering Infamously E products and services but do not replace Infamously E as your merchant contact.

Eligibility

By making a purchase, you represent that you are legally able to enter into the transaction or are acting with the permission of a parent or legal guardian where appropriate.

Product Information

We make reasonable efforts to accurately display our products. However, the appearance of colors, scale, brightness, fabric, texture, and printed artwork can vary depending on your device or display settings, garment material, printing method, garment dye or wash, and production variation. Product images and lifestyle images may include digital mockups or representative photography. Minor variations that do not materially change the product are not necessarily defects.

Made-to-Order Merchandise

Many Infamously E products are produced after the customer places an order. For this reason, customers are responsible for reviewing the selected size, color, style, quantity, shipping address, and other order details before completing checkout. Because production begins soon after checkout, orders cannot be cancelled or changed by the customer once placed, except as described in our Returns, Refunds & Cancellations policy, which forms part of these Terms.

Prices

Prices may change at any time before an order is completed. A price change after a completed purchase does not ordinarily affect the price of that completed order. Applicable taxes, shipping charges, discounts, and other charges are displayed during checkout where applicable.

Orders

We reserve the right, to the extent permitted by law, to decline, limit, cancel, or review orders when reasonably necessary, including situations involving suspected fraud, payment problems, pricing or listing errors, inventory or production unavailability, abusive purchasing behavior, suspected unauthorized resale activity, or technical errors. If we cancel a paid order that has not been fulfilled, the appropriate refund will be processed.

Payment

By submitting payment information, you represent that you are authorized to use the payment method. Payment processing may be performed by Shopify or other authorized payment service providers.

Shipping, Returns and Refunds

Our Shipping & Delivery Policy and Returns, Refunds & Cancellations policy form part of these Terms. Delivery estimates are estimates unless expressly stated otherwise. Nothing in these Terms eliminates consumer rights that cannot legally be waived.

Intellectual Property

Unless otherwise stated, the Infamously E name, branding, artwork, product graphics, designs, written content, photographs, videos, music-related artwork, character artwork, logos, slogans, and other creative materials appearing on the store are owned by or licensed to Infamously E. Purchasing a physical product does not transfer ownership of the underlying artwork, intellectual property, trademarks, copyrights, or other creative rights. Customers may not reproduce, manufacture, commercially distribute, sell, license, scrape, copy, or create unauthorized merchandise from our protected creative content.

Reviews and User Content

If you voluntarily submit a product review, photograph, testimonial, comment, or other content for public use, you represent that you have the right to submit that material. We may display submitted reviews or customer content in connection with our store and products where permitted by the terms under which it was submitted. We will not knowingly represent materially altered customer statements as authentic customer statements.

Prohibited Conduct

You may not use our website or services to commit fraud, attempt unauthorized access, introduce malware or malicious code, scrape the site in violation of applicable law or access restrictions, impersonate another person, submit intentionally fraudulent claims, interfere with store operation, violate another person's intellectual-property rights, or use our services for unlawful purposes.

Third-Party Services

Our store may rely on third-party technology and service providers. We are not responsible for independent third-party websites or services that are outside our control, except to the extent applicable law imposes responsibility on us. Statements made by third parties about Infamously E products are not binding on Infamously E unless authorized by us.

To the fullest extent permitted by applicable law, products and services are provided subject to the warranties and rights expressly stated by Infamously E and those rights that cannot legally be excluded. Nothing in these Terms disclaims warranties or remedies that applicable law does not permit us to waive.

Limitation of Liability

To the fullest extent permitted by applicable law, Infamously E will not be liable for indirect, incidental, special, or consequential damages arising from use of the website or products where such exclusions are legally permitted. Nothing in this section limits liability that applicable law prohibits us from limiting.

Governing Law

These Terms are governed by the applicable laws of the United States and the State of Washington, without eliminating mandatory consumer protections that may apply to a customer's transaction.

Severability and Changes

If a provision of these Terms is determined to be unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law. We may update these Terms periodically; the version posted when you place an order applies to that transaction to the extent required by law.
